Welcome to Zoomie Club.
These Terms of Service ("Terms") govern your access to and use of the Zoomie Club website, online store, products, services, and related features (collectively, the "Services").
The terms "we," "us," "our," and "Zoomie Club" refer to the business operating under the assumed name ZOOMIE CLUB, owned and operated by Charles Tantah.
Zoomie Club operates its online store through Shopify, which provides the technology and services that enable us to offer our Services.

Zoomie Club reserves the right to accept or decline an order for any reason, including circumstances involving product availability, pricing errors, suspected fraud, or other issues.
An order is not accepted until Zoomie Club confirms acceptance of the order.
We may cancel or modify an order when reasonably necessary, including when information relating to the order is inaccurate or when we are unable to fulfill the order.
If we cancel an order after payment has been received, we will issue an appropriate refund for the amount paid for the canceled order.

SECTION 4 - PRICES AND BILLING
Prices, discounts, promotions, and product availability may change without notice.
The price charged for a product will generally be the price displayed at the time the order is placed, subject to applicable corrections or errors.
You agree to provide accurate and complete billing and payment information.
You represent that you are authorized to use the payment method provided for your purchase.
You agree to pay all charges associated with your order, including applicable shipping, handling, and taxes where applicable.
SECTION 5 - SHIPPING AND DELIVERY
We will make reasonable efforts to process and ship orders within the timeframe stated at checkout or in the applicable order information.
Delivery dates and times provided by carriers are estimates and are not guaranteed unless expressly stated otherwise.
We are not responsible for delays caused by shipping carriers, weather, customs processing, incorrect or incomplete delivery information provided by the customer, or other circumstances outside our reasonable control.
Customers are responsible for providing an accurate shipping address.
Once an order has been transferred to the shipping carrier, delays caused by the carrier are outside our direct control.
Nothing in these Terms limits any rights you may have under applicable law regarding delayed or undelivered orders.
SECTION 6 - RETURNS, EXCHANGES AND REFUNDS
Returns, exchanges, and refunds are subject to our applicable Refund and Return Policy.

If a return is approved by Zoomie Club, Zoomie Club will cover the cost of return shipping for that approved return.
Customers should not send products back without first contacting Zoomie Club and receiving return instructions.
Returned products must comply with any applicable requirements communicated by Zoomie Club as part of the return authorization process.
Refunds will be processed after the returned product has been received and reviewed, where applicable, and will be issued to the original payment method unless otherwise agreed or required by law.
Nothing in this section limits any non-waivable rights or remedies available to consumers under applicable law.
SECTION 7 - INTELLECTUAL PROPERTY
All content made available through the Services, including trademarks, logos, brand names, text, graphics, photographs, product images, videos, audio, designs, layouts, and other materials, is owned by Zoomie Club or its licensors, unless otherwise indicated.

The Zoomie Club name and related branding may not be used in connection with any product or service that is not authorized by us.

Our online store is hosted and powered by Shopify.
Shopify provides the technology and infrastructure that allows us to provide our Services to you.
However, purchases made through our store are transactions between you and Zoomie Club.
Shopify is not responsible for the products sold by Zoomie Club or for any aspect of the transaction between you and Zoomie Club, except to the extent required by applicable law.

To the maximum extent permitted by law, our total liability arising from a particular transaction will not exceed the amount you actually paid to Zoomie Club for the product or service giving rise to the claim.
Nothing in these Terms limits liability that cannot legally be limited or excluded under applicable law.

To the extent permitted by applicable law, you agree to indemnify and hold harmless Zoomie Club, its owner, affiliates, service providers, and representatives from claims, liabilities, damages, losses, and reasonable expenses arising from your violation of these Terms, your misuse of the Services, or your violation of the rights of another person or entity.

If any provision of these Terms is determined to be unlawful, invalid, or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

We may suspend or terminate your access to the Services when reasonably necessary, including if you violate these Terms or engage in fraudulent, abusive, unlawful, or harmful conduct.
Termination will not affect rights or obligations that arose before termination.
Sections that by their nature should survive termination will continue to apply after termination.

When we make changes, we will update the "Last Updated" date at the beginning of these Terms.
Your continued use of the Services after updated Terms are posted constitutes acceptance of the updated Terms to the extent permitted by applicable law.
SECTION 23 - FORCE MAJEURE
Zoomie Club will not be responsible for delays or failures caused by circumstances beyond our reasonable control, including natural disasters, severe weather, acts of government, labor disruptions, transportation interruptions, carrier delays, internet or technology failures, supply shortages, or other circumstances beyond our reasonable control.
SECTION 24 - NO WAIVER
Our failure to enforce any provision of these Terms does not constitute a waiver of our right to enforce that provision in the future.
Any waiver must be made in writing or otherwise expressly communicated by Zoomie Club.
